Ask and LookSmart Send Out Click Fraud Settlement Letters

Seems Lane's Gifts are not the only ones getting money back from LookSmart and Ask for click fraud, letters were sent out yesterday for the class action suit that both companies are trying to put behind them.

Both seem to be written by the same law firm and were from the suit lodged in the Circuit Court of Miller County, Arkansas. LookSmart is dealing with the period between January 1, 2002 and the present; while Ask is covering claims beginning August 1, 2005, when it began licensing LookSmart's technology for its Ask Sponsored Listings product.

Claims must be filed to LookSmart by February 11, 2008 and to Ask by February 2, 2008.

Payment seems to be in advertising credits as opposed to cash. Guess if you have gotten out of the online business you could sell the credits.

Copies of the two letters are below.

LookSmart's letter read:

"If you purchased online advertising from LookSmart between January 1, 2002 and the present, you may be a class member in a class-action lawsuit, Lane's Gifts and Collectibles et al. v. LookSmart, Ltd. et al., Case No. CV-2005-52-1, in the Circuit Court of Miller County, Arkansas. The Settlement Notice informs you of the Court's certification of a class for settlement purposes; the nature of the claims alleged; your right to participate in, or exclude yourself from, the class; a proposed settlement; and how you can claim an award of advertising credits under the settlement or object to the settlement.

- The proposed settlement will provide advertising credits to class members who certify that they were the victims of "click fraud" or other invalid or improper clicks on online advertisements purchased from LookSmart on or after January 1, 2002.

- The proposed settlement will resolve claims that LookSmart breached its contracts with advertisers and violated other laws by failing to adequately detect and stop "click fraud" or other invalid or improper clicks on online advertisements.

- If you are a member of the class, your legal rights are affected by whether you act or do not act.

For a copy of the Settlement Notice, click on the link, or visit the case website at LooksmartSettlement.com

To file a claim for your award of advertising credits under the settlement, click on the following link: LooksmartSettlement.com/claim

Note: You should review the Settlement Notice as soon as possible as there are several important deadlines that you must meet to take certain actions in connection with this proposed settlement. As indicated above, your legal rights are affected whether you act or do not act. The deadline for filing an objection or excluding yourself from the proposed settlement is January 29, 2008, and the last day to file a claim under the proposed settlement is February 11, 2008. For further information, please refer to the Settlement Notice." The Ask letter reads:

"If you purchased online advertising from IAC Search & Media, Inc. and/or Ask Jeeves, Inc. (collectively "Ask") between August 1, 2005 and the present, you may be a class member in a class-action lawsuit, Lane's Gifts and Collectibles et al. v. Ask Jeeves, Inc. et al., Case No. CV-2005-52-1, in the Circuit Court of Miller County, Arkansas. This notice advises you of your legal rights.

You should review the detailed Settlement Notice as soon as possible, as there are several important deadlines that you must meet to take certain actions in connection with a proposed settlement of the class action lawsuit. Your legal rights are affected whether you act or do not act. The deadline for filing an objection or excluding yourself from the proposed settlement is February 2, 2008, and the last day to file a claim under the proposed settlement is February 2, 2008. For further information, please refer to the Settlement Notice.

The Settlement Notice informs you of the Court's certification of a class for settlement purposes; the nature of the claims alleged; your right to participate in, or exclude yourself from, the class; a proposed settlement; and how you can claim an award of advertising credits under the settlement or object to the settlement.

LookSmart's Zeal Directory To Close

Once a potential rival to the Open Directory, LookSmart had decided to close its volunteer-driven Zeal directory at the end of this month. LookSmart acquired the service in 2000. Though the Zeal site itself is still accepting registrations, here's the closure message LookSmart's sent out:

Dear Valued Zealots and Contributors,

Thank you for being a part of the Zeal community and contributing your time and knowledge to the Directory. After trying to put the deserved resources behind Zeal, we have made the conscious decision to shut down Zeal.com. On March 28, 2006 Zeal will no longer be available. We are not selling Zeal.com and have no future plans for it at this time.

We think that avid Zeal users will appreciate the large, interesting and vital community at Furl.net (www.furl.net). Furl is an online book marking service that helps you save information that’s important to you, share it with others and see what others are saving and find important.

With Furl you can:

  • Save Web pages to a personal, permanent archive with 5GB of storage
  • Revisit the full text of your favorite Web pages
  • Share articles and information with friends and family members with simple email pass-along tools
  • Use Furl as a platform for social networking and discovering useful information
  • Share articles and information with people that share common interests using RSS feeds
  • See what other Furl members are saving and sharing
  • Save your favorite Zeal content

Whether you are browsing the Web, travel planning, recipe sharing, house hunting or researching, Furl is a wonderful tool. Join the thousands of people that are using Furl every day to find, save and share information that is important to them.

Postscript: Chris Fillius who was involved with Zeal early on shares some thoughts on its demise in Zeal.com, R.I.P. at his Search Lounge blog, plus Guest Obituary for Zeal, by Alice Swanberg there has some further thoughts on the closure.

Imagery Comes to LookSmart's FindArticles

RLG, a highly respected organization in the library world with more than 150 research libraries as members, has announced a partnership with LookSmart.

Today's announcement brings access to RLG's Trove.net database of "209,000 rare and unusual images" to searchers via LookSmart's FindArticles, a LookSmart site.

Trove.net contains works from 300 BCE to the present and includes a variety of images from leading cultural heritage collections. The works represented range from papyrus fragments from ancient Greece, to Chaucer's "The Canterbury Tales," to vintage advertising labels, to 20th-century architectural photos. These images can be licensed for use by individuals and businesses. RLG's Trove.net contains works from major international collections—national libraries and renowned universities—as well as images from many other museums, libraries, and archives.

Here's an example search for the term "baseball." At the bottom of the results page you should spot an image result. Click, and you'll see a larger thumbnail with the chance to click again and see the full image. Those with institutional memberships to RLG Cultural Materials can click through to the image while those who don't can license the image for various types of use.

Btw, if the initials RLG sound somewhat familiar, they should. SearchDay published an article I wrote last week about RLG's wonderful and free bibliographic database named RedLightGreen.

Harsh Words for New Looksmart Vertical

About.com Mutual Funds Guide Dustin Woodard decided to test out one of Looksmart's recently launched vertical sites, so he focused on the category he knows best: Mutual funds. In LookSmart Fund Site a Failure, he writes that the search and content organization is poor, and featured "web picks" are out of date and may even be unlabeled paid placements. His bottom line: "It goes to show that it takes more then an unknowledgeable editor and some search programmers to create a quality site."

Looksmart Goes Vertical

Looksmart is turning itself into an About.com style portal, launching 161 vertical search sites in 12 categories including automotive, cities, food, health, home, sports and travel. Unlike About, Lookmart's vertical sites are not put together by human editors, but are assembled using technology.

"We decided if we could do this on a highly automated basis, we thought it would be a very good business," Looksmart CEO Dave Hills (also former COO and president of sales at About) told ClickZ's Pamela Parker.

The company continues to run its paid search and contextual advertising network.

LookSmart Faces Delisting

Times might be rosy for the likes of Google and Yahoo, revenue-wise -- but LookSmart's having a tough time. Investors Turn Cold Shoulder to LookSmart from ClickZ notes that the company's stock has been under the $1 per share mark for more than 30 days. If shares don't trade for above that at least 10 of the next 180 days, he company will be delisted. Shares are at $0.80, when I looked today.

LookSmart Launches Five New Verticals

Search verticals are hot so LookSmart launched five new vertical sites today aimed at different user groups. Each offers access to FindArticles material along with a interface to search the LookSmart web index.

+ Teenja (For Teens) + GradeWinner (For Tweens) + 24Hourscholar (For the College Student) + ParentSurf (For Parents) + GoBelle.com (For Moms on the Go) I guess if you're a mom (who's on the go) and is also a college student, you could use three of these sites. (-:

Each vertical lists a human editor who selects articles from the FindArticles. However, I was unable to find what criteria these editors use to determine what is and isn't material worthy of inclusion into each vertical.

I wondered if results from the LookSmart web index would be targeted for each user group. I ran the same web search at 24hrscholar and Teenja and got the same results. Finally, I found adult material at Teenja and GradeWinner but was unable to find any type of filter to remove (or try to remove) adult content. This could make use of these sites in the K-12 community an issue.

More about the new LookSmart verticals in this news release. Thanks to S.C. for the news tip.

I've said many times before that it's really sad when students and the general public for that matter don't know that thousands of public libraries offer full text and free access to thousands of sources (newspapers, magazines, full text reference books that are accessible with a library card WITHOUT having to visit the library.

Here's an idea of what I'm talking about from a library in my area. Wow! Again, every library offers different services but overall, this is high quality material including many tools aimed at students. Of course, all universities also provide access to many full text databases and reference tools accessible from dorm, home, office, etc.

For more on free library databases, take a look at this SearchDay article.

LookSmart Reorganizes, Raises Loss Projections

LookSmart has revised the loss it expected to make last quarter from less than $1 million up to $1.4 to $1.7 million. Reason? Lower revenues due to not getting as many new advertisers as hoped. In reaction, the company has reorganized into two divisions: consumer products and paid listings/syndicated technologies, with new execs named to lead those. More details from ClickZ: LookSmart Warns, Shuffles Execs.

LookSmart Adds Porn-Free Search to Net Nanny

Looksmart has integrated web search into its NetNanny 5.1 web filtering software. The search engine is based on a LookSmart-powered search index, presumably drawing from the Wisenut crawler the company purchased several years ago.

Those of you needing filtering software may want to try a test drive with the free 15 day trial. Before you do, be sure to read Walt Mossberg's recent review comparing NetNanny, CyberPatrol and FilterLogix. According to Mossberg, "Net Nanny failed to block some blatantly inappropriate Web pages, so we can't recommend it."
